Welcome to Momentales. These Terms of Service ("Terms") govern your use of our website and services at momentales.com (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Momentales provides a platform for creating personalized illustrated books — including storybooks and memory books — generated from user-submitted ideas, memories, and personalization details. Books may be purchased in digital and physical formats.

2. Eligibility and Accounts

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. If you create an account, you are responsible for maintaining its security and for all activities under your account. You may sign in using Google OAuth; your use of Google sign-in is also subject to Google's terms.

The Service is accessible without requiring an account for certain features (such as creating and previewing books as a guest). Purchasing a book requires checkout through Stripe.

3. User Content

You are responsible for all content you submit to the Service, including story ideas, memories, personal details, and photos. You represent and warrant that:

• You own or have the right to use all content you submit.
• Your content does not infringe on any third-party rights.
• Your content does not violate any law or regulation.

We reserve the right to refuse to process content that is unlawful, defamatory, harassing, or otherwise objectionable.

4. AI-Generated Content

Books are generated using artificial intelligence based on your inputs. While we strive for quality and consistency, we do not guarantee that generated content will be free of errors, inaccuracies, or unexpected results. AI-generated content is provided "as is" and may not always reflect factual accuracy, especially in memory-based books. You are responsible for reviewing the final book before purchase.

5. Purchases and Payments

• All purchases are processed securely by Stripe.
• Prices are displayed in USD and are subject to change.
• Upon successful payment, you receive the access level corresponding to your purchase (digital access and/or physical hardcover).
• Physical book fulfillment is subject to availability and shipping timelines.

6. Refund Policy

Due to the personalized and AI-generated nature of our books, digital purchases are generally non-refundable once the digital book has been accessed or downloaded. If you experience a technical failure or significant quality issue, please contact us at support@momentales.com and we will work to resolve the issue. Physical hardcover orders may be eligible for refund or replacement if the book arrives damaged or defective — please contact us within 14 days of delivery.

7. Intellectual Property

You retain ownership of the content you submit. The AI-generated book created from your inputs is licensed to you for personal use upon purchase. You may share your book using the private sharing links provided by the Service. The Momentales platform, branding, software, and design are owned by us and protected by intellectual property laws.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Submit content that is harmful, offensive, or infringes on others' rights.
• Attempt to disrupt, hack, or reverse-engineer the Service.
• Resell or commercially exploit books without authorization.
• Use automated tools to scrape or overload the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure access to the Service. AI-generated content may contain inaccuracies and should not be relied upon for factual or historical accuracy.

10. Limitation of Liability

To the maximum extent permitted by law, Momentales shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, profits, or goodwill. Our total liability shall not exceed the amount you paid for the book or service giving rise to the claim.

11. Indemnification

You agree to indemnify and hold Momentales harmless from any claims, damages, or expenses arising from your use of the Service or from content you submit.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases, though you may retain access to books you have already purchased.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
